Talkdesk, Inc. (hereinafter, “Talkdesk”) is a US based company (353 Market Street, level 1, San Francisco, CA 94111 – United States) that acts on the CCaaS (Contact Center as a Service).

Talkdesk describes hereafter why we collect and process your personal data, on which legal basis, and how we treat the personal data you provide us and the personal data we obtain from your registration to this microsite.

This Notice aims to provide you information about how Talkdesk will use your personal data when you use this microsite to attend or participate in Talkdesk SingDesk contest, as described in Contest Rules.

Use of Personal Data: Your Personal Data will be used exclusively within the scope of management of the exclusive competition, SINGDESK, to Staffs of the organization and only to the extent necessary to allow Talkdesk to:

Register your team participation: Talkdesk collects information about you and your team members limited to what is relevant, proportional, adequate, and necessary for identified purposes which your specific consent is given to Talkdesk by clicking on the participation button. Disclose your videos to Talkdesk Community: Talkdesk will have access and will disclose your team video with the Talkdesk community for contest purposes only. Talkdesk will only have access to the link provided by your team leader that can be hosted in a third-party provider not contracted by Talkdesk. Talkdesk will only use video recordings or images for other purposes with your consent. Allow access to the videos and vote: If you are a Talkdesker, we will use and share your business email with a reliable provider for the sole purpose of allowing you to have access to the contest videos and vote. SINGDESK CONTEST Votes: based on your acceptance of the Terms and conditions for online voting in the SINGDESK, Talkdesk can process your votes, aggregate statistics, calculate and determine the official results of the SINGDESK. Through Third Parties: Talkdesk may use trusted third parties receiving contact information or having access to your videos, but we will ensure that appropriate measures are implemented according to the applicable national legislation relating to data protection.

Legal basis: Talkdesk is only processing your personal data according to the legal basis to do so. Since this participation is voluntary, prizes will be given and we will provide you the Contest Rules for your knowledge, Talkdesk relies on the performance of a contract to process your video. For other kinds of further processing of your video or image, we will only use it with your consent. When the legal basis of the processing is consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of any processing carried out before the withdrawal of consent. For the purpose of providing access to contest videos and vote, we base the sharing of your business email in Talkdesk legitimate interest of providing and promoting the involvement of Talkdesk Community.

Personal data collected: Talkdesk collects personal data relating to you (referred to hereinafter as "Personal Data") in a various ways:

Through Registration: Participating in the competition SINGDESK requires that you register and provide us your and your team members' personal data. Registration is governed by the Terms of use of the microsite. Through your Shared Links: Videos and images shared with Talkdesk can be used or shared for competition’s reasons only. Talkdesk will not store your videos and will only have access to disclose them to the Talkdesk Community. Through your Votes: You may vote online, via this competition microsite, if you are a registered user and a Talkdesk Staff. Talkdesk is allowed to collect all the votes. To calculate the official results of the SINGDESK, the three favorite performances will be organized, attributing 5/10/12 points respectively. Through Cookies, IP addresses, and location data: We may also collect certain information when you visit our microsite (also as a non-registered user), through cookies, IP addresses, location data, pixels, and similar technologies; information about how we use them and what types of information are collected via cookies is described in detail below.

Appropriate privacy and security assessments are performed to ensure compliance with applicable laws and regulations and ensure the data collection is lawful and uses fair means. Talkdesk collects personal information that you voluntarily provide to us when you decide to participate in SINGDESK. Talkdesk may combine the Personal Data you submit via the microsite with other personal data we have obtained from other sources to deliver the prizes. Talkdesk will not use your Personal Data for any new purposes which are as yet unforeseen in this Privacy Notice, except to comply with a legal obligation. In any event, before using Personal Data for other purposes, our Privacy Notice will be updated, and we will inform you of the change. We will not process your Personal Data for new purposes for consent-based activities without first obtaining your consent.

Special categories of personal data: We will not collect or process any other special category of personal data relating to you, such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or other beliefs of a similar nature, trade union membership, genetic data, biometric data for uniquely identifying a natural person, health, sex life or sexual orientation.

Your Rights: Without prejudice to the limitations justified by the legal basis used for data processing, you have the right to access, right to rectification, right to erasure, right to restrict processing, right to data portability, right to object, right not to be subject to automated decision-making, right to withdraw consent and right to complaint.
